These Terms of Use govern your use of BPal (“the App”). Please read them carefully. They supplement the licence agreement under which the App is supplied to you through the App Store — see Section 2.

1. Who We Are

The App is provided by Muhammet Emre Yılmaz, trading as LuvleeLab, Hildesheimer Str. 120, 30173 Hannover, Germany (“LuvleeLab”, “we”, “us”). Full provider details are set out in our Impressum. You can reach us at support@getbpal.app.

2. Relationship to the Apple Standard EULA

The App is licensed to you under Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”), which Apple makes available at apple.com/legal/internet-services/itunes/dev/stdeula. That agreement governs the licence itself — its scope, the permitted devices, and the terms Apple requires, including that Apple is not responsible for the App or for providing maintenance and support, and that Apple and its subsidiaries are third-party beneficiaries of the licence.

These Terms of Use supplement the Apple Standard EULA and describe matters specific to BPal: what the App does and does not do, the Premium subscription, our handling of your data, and our liability. Where these Terms conflict with the Apple Standard EULA on a matter of licence scope, the Apple Standard EULA prevails. Apple is not a party to these supplemental Terms and has no obligations under them, but Apple and its subsidiaries may enforce the Apple Standard EULA against you as third-party beneficiaries.

How we handle your data is described in our Privacy Policy. That policy is an information notice explaining our processing — it is not a contract and you are not asked to agree to it.

3. Eligibility

You must be at least 16 years old to use the App. This reflects the age of digital consent under Article 8 of the General Data Protection Regulation in Germany, where we are established. If you are under 16, please do not use the App.

If you are under 18, any purchase must be made or authorised by the holder of the Apple Account and, where your local law requires it, by your parent or legal guardian. Parents and guardians are responsible for supervising their children’s use of connected devices.

4. What the App Is — Scope of the Service

This section defines what we undertake to provide. It is a description of the service, not a limitation of liability.

BPal is a logging and organisation tool for blood pressure readings that you take with your own monitor. What we undertake to provide is: a place to record readings and weight entries; a history you can browse, and search and filter with Premium; charts and arithmetic summaries calculated from the readings you have entered; PDF and CSV exports of that data; reminders; optional exchange with Apple Health; and, from the update in which it is released, optional import from compatible Bluetooth monitors (Section 8).

We do not undertake to provide, and the App does not provide: any measurement of blood pressure; any diagnosis, screening, risk assessment, prediction or prognosis; any monitoring in the clinical sense; any continuous or background monitoring of your condition; any treatment recommendation; any interpretation of your readings in light of your individual medical circumstances; or any emergency detection, alerting or response service.

The App does apply published blood pressure ranges to the readings you enter, and visually highlights readings that fall above published thresholds — see Section 5. These are static labels reproducing published reference guidance. They are not an assessment of your condition, not continuous monitoring, and not emergency detection. The App cannot summon help and will not contact anyone on your behalf.

BPal is intended as a personal blood pressure log and general-wellness reference tool. It is not CE-marked as a medical device, is not intended for use as one, and must not be relied on as one.

5. Medical Disclaimer

The App is not a measuring device. It does not measure blood pressure. All logs, categories, averages, distributions, MAP figures, statistical summaries and reports it produces are for informational and personal self-monitoring purposes only. They are calculated solely from the data you have entered and do not account for your individual clinical circumstances.

The App does not provide medical advice, diagnosis or treatment. A single reading cannot diagnose hypertension. Do not make treatment decisions, adjust medication or change your care on the basis of information shown by the App. Always consult a qualified healthcare professional.

The App highlights readings where systolic is over 180 or diastolic is over 120, because published guidance treats that range as needing prompt attention. That highlight is general reference information, not a diagnosis and not a detection of an emergency. If you record such a reading, or you have symptoms such as chest pain, shortness of breath, weakness, vision changes or trouble speaking, contact emergency services yourself. The App will not do this for you.

Blood pressure categories shown in the App reproduce published AHA/ACC and ESH thresholds. They are shown for reference and do not constitute an assessment of your health.

Nothing in this section limits our liability. Our liability is governed by Section 15.

6. Premium – Subscription

The App is free to download and includes unlimited manual logging, the Home screen, the full History list with multi-select and bulk delete, the seven-day chart and all of its sections, two active blood pressure reminders, a one-time import from Apple Health, the Home Screen and Lock Screen widgets, and one export (PDF or CSV, covering a range of up to 30 days). Premium unlocks the longer chart ranges (30 days, 90 days, six months, one year and all time), the search, filter and date-range tools in History, unlimited PDF and CSV exports, further reminders (within the limit iOS places on pending notifications), ongoing Apple Health synchronisation and, once the Bluetooth import feature is released, continued monitor imports; and it removes advertising.

  • Premium is offered as an auto-renewing subscription. A one-time lifetime purchase may also be available. The plans currently on offer are shown in the App.
  • A free trial period may be offered. If you do not cancel before the trial ends, your subscription begins and the then-current price is charged to your Apple Account.
  • Pricing is displayed in the App Store in your local currency at the time of purchase. Prices may vary by region.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • You can manage or cancel a subscription at any time in iOS Settings › your Apple Account › Subscriptions.
  • Family Sharing is not available for Premium.
  • Cancellation takes effect at the end of the current billing period; Premium features remain available until then.
  • If we increase the price of an existing subscription, Apple will notify you and, where Apple’s rules require it, ask for your consent before the new price applies. If you do not consent, the subscription will not renew at the higher price.
  • All payments are processed by Apple. Refunds are handled by Apple under Apple’s refund policy; we cannot issue refunds for App Store purchases ourselves, although you are welcome to contact us and we will help where we can.

7. Apple Health (HealthKit)

With your permission, the App reads blood pressure, heart rate and weight from Apple Health, and writes blood pressure and heart rate back to it. It never writes weight to Apple Health. You may grant or revoke this access at any time in iOS Settings › Health › Data Access & Devices. The App remains fully usable with manual entry if you do not grant access.

We do not control the Apple Health app or data written to it by other applications, and we do not undertake to reconcile discrepancies between BPal and other apps sharing the same Health store.

8. Bluetooth Monitors

Not enabled in the current App Store version. Bluetooth import is not part of the App as currently released. This Section applies from the update in which the feature is released.

The App can import readings from blood pressure monitors that implement the standard Bluetooth Blood Pressure Profile, and from certain Omron models. Compatibility depends on the device, its firmware and its manufacturer, and we do not guarantee it for any particular model. Support for an individual model may end if its manufacturer changes the device’s firmware or protocol.

LuvleeLab is not affiliated with, endorsed by or sponsored by any monitor manufacturer. We are not responsible for the measuring accuracy of the monitor itself — follow your monitor’s own instructions for how to measure correctly. This does not exclude our responsibility for defects in the App’s own import, storage, calculation or display of your data.

9. Your Data

Your readings are stored on your device. You are responsible for maintaining your own backups, and for the security of any backup file or exported report you create, since these contain your health data.

Because we hold no copy of your readings, we cannot recover data lost through device loss, device failure, deletion of the App, or a restore performed without a current backup. Please export a backup regularly. How data is handled is described in the Privacy Policy.

10. Acceptable Use

You agree not to:

  • reverse engineer, decompile or disassemble the App, except to the extent such acts are permitted by mandatory law (including §§69d and 69e of the German Copyright Act);
  • use the App for any unlawful purpose or in violation of any applicable regulations;
  • attempt to circumvent or disable any subscription or advertising mechanism;
  • remove or alter any copyright, trademark or other proprietary notice within the App;
  • use the App to provide a service to third parties, or present its output as a clinical assessment.

11. Intellectual Property

All content, design, graphics and code within the App are the property of LuvleeLab or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you. Your readings and the notes you write remain yours.

12. Third-Party Services

The App integrates third-party services including Google AdMob, RevenueCat, Mixpanel and Sentry. Your use of these services is subject to their respective terms and privacy policies, and what each receives is described in Section 8 of the Privacy Policy. We are not responsible for the practices of these third parties, but we remain responsible for our own choice to engage them and for the instructions we give them.

13. Availability, Updates and Changes to the App

We aim to keep the App available and working, but we do not warrant uninterrupted availability. The App depends on your device, your operating system version and, for some features, on third-party services outside our control.

We may modify, add or remove features only where there is a valid reason to do so, namely: to comply with a legal or regulatory requirement; to respond to a change in Apple’s platform, guidelines or APIs; to respond to a change made by a third-party service or a monitor manufacturer; to address a security vulnerability or defect; or to adapt the App to technical developments. Any such change will be made at no additional cost to you.

Where such a change would adversely affect your access to or use of a paid Premium feature, we will inform you a reasonable time in advance on a durable medium of the change, its reasons, its timing, and of your right to terminate. In that case you may terminate your subscription free of charge within 30 days of the change or of being informed, whichever is later, and we will ask Apple to refund the unperformed portion of the period you have paid for. Your rights under §327r of the German Civil Code and other mandatory law are unaffected.

We will provide the Premium features you have paid for throughout the subscription period you have paid for, unless immediate discontinuation is legally or technically unavoidable. If we discontinue the App altogether, we will give reasonable notice so that you can export your data before support ends, and we will not renew subscriptions after that notice. Your data remains on your device.

14. Warranties and Defects

Nothing in these Terms excludes or limits mandatory statutory rights concerning digital products, including rights under §§327 ff. of the German Civil Code where they apply.

Apple is the merchant and contractual transaction provider for purchases made through the App Store, and handles payment, withdrawal and transaction refunds. We remain responsible for the App itself — its content, functionality, maintenance and support — and for claims attributable to us under applicable law and the Apple Standard EULA. In practice: for a payment, billing or refund question, contact Apple first; for a defect, a malfunction or a technical problem with the App, contact us.

Beyond your statutory rights, we give no separate guarantee (Garantie) and make no representation that the App will meet any particular requirement of yours, that it will be compatible with any particular monitor or device, or that it will be free of every error. We do not warrant that use of the App will be uninterrupted.

15. Limitation of Liability

We are liable without limitation:

  • for damage arising from injury to life, body or health caused by a breach of duty by us, our legal representatives or the people we use to perform our obligations;
  • for damage caused intentionally or by gross negligence;
  • for claims under the German Product Liability Act (Produkthaftungsgesetz);
  • where we have fraudulently concealed a defect or have assumed a guarantee.

Where we breach a material contractual obligation through simple negligence, we are liable, but our liability is limited to the foreseeable damage typical for this kind of agreement. A material contractual obligation is one whose fulfilment makes the proper performance of these Terms possible in the first place and on whose observance you may regularly rely.

Any liability beyond the above is excluded.

These provisions apply equally to the personal liability of our legal representatives, employees and the people we use to perform our obligations. They do not alter the burden of proof to your disadvantage.

Nothing in this Section limits our liability under mandatory law in your country of residence, where that law gives you greater protection.

16. Termination and Survival

You may stop using the App at any time by deleting it from your device. Deleting the App does not cancel a subscription — cancel it as described in Section 6.

We may terminate these Terms and your licence for good cause, in particular a serious or repeated breach of Section 10, and where appropriate after giving you notice and an opportunity to remedy the breach. On termination you must stop using the App and delete it. Your data remains on your device and you may export it first.

Sections 4, 5, 9, 11, 14, 15, 17, 19, 20, 22 and 23 survive termination of these Terms.

17. Feedback

If you send us suggestions, feature requests, bug reports or other feedback, you grant us a non-exclusive, worldwide, royalty-free right to use it to improve the App, without obligation and without compensation. You are not required to send us feedback, and we do not treat it as confidential — please do not send us anything you consider confidential or that you are not free to share. This does not give us any right to your health data.

18. Consumer Rights and Right of Withdrawal

Nothing in these Terms affects mandatory consumer protection rights that you have under the law of your country of residence.

Purchases of Premium are made from Apple, which acts as the merchant for App Store transactions. Apple therefore processes payments, withdrawal requests and transaction refunds, and requests of that kind should be directed to Apple. This does not limit any statutory right or claim you may have against us in relation to the App itself. Where Apple applies its own more generous refund practice, that applies in addition to your statutory rights, not instead of them.

19. Dispute Resolution

If you have a concern about the App, please contact us first at support@getbpal.app. We aim to respond within 14 days and to resolve most matters informally.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG). This statement does not affect your right to bring a claim before the courts.

20. Governing Law

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you are habitually resident. As a consumer you may also bring proceedings in the courts of your own country of residence, and we will bring any proceedings against you in those courts.

21. Changes to These Terms

We may amend these Terms where there is a valid reason to do so, such as a change in the law, a change in the App’s features, or a change in the third-party services it relies on.

If a change is material and affects your rights or obligations, we will give you at least 30 days’ notice on a durable medium before it takes effect, and we will update the date at the top of this page. If you do not accept the change, you may stop using the App and cancel any subscription before the change takes effect. Non-material changes — corrections, clarifications and editorial edits — take effect when posted.

22. General Provisions

Severability. If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions is unaffected. The invalid provision is replaced by the applicable statutory rule.

No waiver. If we do not enforce a right under these Terms, that is not a waiver of that right.

Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours in connection with a transfer of the App as a whole, provided your rights are not diminished; you may terminate if that happens.

Entire agreement. These Terms and the Apple Standard EULA together form the entire agreement between you and us regarding the App.

Third parties. Apart from Apple as described in Section 2, no third party has any rights under these Terms.

23. Language

These Terms are published in English and in German. Any other translation is provided for convenience only; in the event of a discrepancy, the English text prevails, except where mandatory law in your country of residence requires otherwise.
